Legal Question in Medical Malpractice in Virginia

HI, I have Cigna Health insurance in network . It was advised by my physician to have lapband surgery(my BMI is over 40). I also use a CPAP machine and that Doctor and a therapist all said they would support my family doctors decission and thinks it would be medically benifical in many areas. I keep getting denied by Cigna, The custormer service departmant of Cigna said our company did not buy that portion of the insurance. I was under the impression that if deemed medically necessary that the insurance is suppose to pay for or pay part of the surgery. Is it legal for them to deny me with 3 doctors from differant fields agree that I should have the procedure done?

No, not if your company has not purchased the necessary healthcare coverage from CIGNA that would provide for this thls kind of

surgery or medical procedure.
