Legal Question in Personal Injury in Virginia

Medical Insurance trying to collect what they paid

I was in a car wreck on Jan 10th of 2007 and was not at fault. I have health insurance (through my employer)and used it to pay for the ER visit (paid my copay, the hospital submitted a claim, my health insurance paid the claim). I received payment from insurance of the person who hit me for the medical bills (based on the full amount charged, not just what I had to pay out of pocket). A recovery service (ACS Recovery) has come back stating that I owe what my medical insurance paid on my behalf because I received that money from the car insurance of the person who hit me. Do I have to pay this money back to them?

Re: Medical Insurance trying to collect what they paid

Not necessarily. You should have an attorney review this to see if you have any defenses (you very well may) or claims against ACS, etc. I would be happy to consult with you or refer you if you like.
