We bought a house with owner financing and now that we have obtained bank financing she wants to back out of the contract. In the meantime, she transferred the property to her family trust. Can we sue her trust?
Very likely, you would name this seller as a defendnat as well as the trust
in any lawsuit filed, but there remains to be clarified the issue of who is now
currently the owner of record, you or the seller? If you "bought" the house, title
should already be in your name and she could not transfer it to her family trust.
