Legal Question in Real Estate Law in Virginia

When is my house ''Sold?''

We are currently having issues with a real estate transaction and I need advice. We provided the sellers with a purchase aggreement contingent upon the sale of our house. We now have a non-contingent contract on our house, and believe the contingency on the sellers contract should be removed as well. Should I be concerned that the listing agent is still holding open houses and has provided us with a 48 hours right of first refusal paperwork dated after we signed our contingency removal adendum. Also they signed the 48 hour first right of refusal paperwork in the Option B area for ''Release Agreement.'' While I have no factual basis, I believe they were trying to trick us into signing it so they could be released from our contract to accept a potentially better offer for their house. Please help!

Re: When is my house ''Sold?''

It might be best to have an attorney review the documents. If the sale of your home is non-contingent and you are comfortable lifting the contingency on the home you are buying, the real estate agent should follow your instructions. If some other document was executed and it was not what you intended, there may be a question of validity.
