Legal Question in Real Estate Law in Virginia

Real Estate Foreclosure

I recently had a foreclosure on my home in Nov 06 but the 2nd mtg was left out. They didnt know anything about the foreclosure and I wanted to know if I am liable for this debt since I dont have the home any more? What can they do to me or do I need to file Bankcruptcy? Thanks

Re: Real Estate Foreclosure

You will remain responsible for paying any deficiency to the first lien holder when it sells the real estate and you remain liable to the second lien holder for the debt. You should consult with a bankrupcy attorney to determine your eligibility.
