Legal Question in Real Estate Law in Virginia

I have a tenent that is a mnth and a half behind on rent, there is no lease and he recieves no mail here how much notice do i have to give before i can evict?

5 day pay or quit notice should suffice. (There is probably a lease which you

don't realize, i.e., because it's an oral, month to month arrangement.)
