Legal Question in Traffic Law in Virginia

Accident, no insurance

While parking a rental moving truck, I sideswiped a parked vehicle. The driver of the parked vehicle and I exchanged insurance information, and the police came. No police report was made. There is no insurance coverage for the rental truck, and the other driver does not want to involve his insurance. I will pay the damages, but the other driver obtained one estimate that seems very high and refuses to get a second one. Should I just pay the amount of the original estimate or insist on a second one, risking that he might refuse and take legal action? Also, he is hinting that there might be further internal damage to the vehicle not included on the estimate. Assuming I pay the original estimate, how can I ensure he cannot come after me for more money for the alleged internal damage?

Thanks.

Re: Accident, no insurance

Two estimates are the norm in this business and you can reasonably demand that he obtain a second estimate.

To prevent him from coming after you after you pay the reasonable estimated cost of repair to his vehicle, you must then have him sign a release or waiver of his right to make future claims against you, of whatever nature they may be, arising out of this one particular accident.
