Legal Question in Traffic Law in Virginia

Eluding and Locations

I was arrested for eluding and reckless driving, but my question is this? THe cop but that i was arrested and clocked somewhere where i wasnt.. I was arrested about 2 miles from where she said i did. In virginia can i bring that up in court and my charges be dropped based on that technicality.

my second questions is that the state trooper originally wrote that i was arrested for attempt to evade, then she changed it to eluding without me signing it, and previously when a cop changed my charge they made me sign off on it... can my case be dropped on this technicality. if you would answer these 2 questions it would be most helpful. Thank you.

Re: Eluding and Locations

At court you can bring up anything you wish in your defense, however, I don't see the charges you've referenced being dropped on the basis of the 'technicalities" which you've described.

Furthermore, since reckless driving(there are about 15 different kinds in Va.)is a jailable offense, you should have an attorney representing you in these matters. If you cannot afford to hire one on your own, you can ask the court to appoint one.
