Legal Question in Traffic Law in Virginia

I was issued a summons for driving with a suspended license. It was suspended due to non insurance for only 1 day on a car I had that wasn't running. I didn't know I had to keep it on the car if it was no longer in use. I sold that car, and I thought once I did that, my license would be ok. I have never had a suspended license, but I was recently put on 1 yr good behavior for a petty larceny charge. That will be up Feb 2nd 2012. Will I go back to jail?

No, not likely, as long as the judge hearing your alleged violation

of the probation matter (predicated on the petty larceny charge) fully understands the situation which led to the issuance of your summons for

DWS (Driving While Suspended).

And, yes, if you are charged with a violation of your probation status,

you might want to retain an experienced criminal defense counsel to

make sure that the judge does fully understand your situation as referenced above.
