Legal Question in Traffic Law in Virginia

My son was charged with failure to yield. he was stopped behind another car. after the car in front of him proceeded he stopped. looked and proceeded to go but then saw a car approaching fast, he stopped quickly to avoid being hit because his 3 year old daughter was in the back seat. the other car lost control. ran off of the road and slammed into a telephone poll, my son. his daughter and his truck were all untouched. We know he is going to need a lawyer. Do you have any advice? and is there an estimated cost? do not know if there is a format or if it is at the lawyers discretion,
