Legal Question in Wills and Trusts in Virginia
In my father's will, he instructed that a house he owned was to go to myself and my sisters. Before he died he took out a 2nd mortgage on the house. The executor of his estate says that not only do we inherit the house but also the debt even though elsewhere in my father's will it stipulates that the estate is to pay all debts. Is the executor correct?
