Legal Question in Workers Comp in Virginia

5 days after falling 20' and sustaining head injuries on a construction site, my friend was told that if he didn't come back to work his employer would be downgraded for safety issues and loose future contracts. He is seriously hurting, on painkillers and has limited vision. He is concerned that the fall could have been avoided and it was his fault. What should he do.

If he has not been released to return to work by his treating doctor he should not go back to work. His health is more important than his employer being "downgraded" for safety issues. He needs to immediately consult an experienced Virginia workers' compensation attorney and he should not give a recorded statement to the insurance company.
