Legal Question in Workers Comp in Virginia

I am a general contractor in virginia specializing in residential remodeling. I don't have any employees. I employ independent sub-contractors to assist in my building. I was under the impression that since I had less than three employees, that I was not required to get Workers Compensation insurance, since that is the responsibility of the sub-contractor. I am being told that is not the case by the Virgina Workers Comp Comission. They say any employees of the sub-contractor are counted in the formula. This is news to me.
