Legal Question in Workers Comp in Virginia

I had surgery decetomy, and the problem seems to have gotten worse,so now my doctor has me on some medication that really has bad side effects, I spoke to a lawyers secretary and she said'' who care if your doped up all the time as long as you feel better'' That was a stupid comment I dont feel better and I dont want to Be an experimental case on finding what might help, how long dose this have to go on? I'd rather settle the case and find my own means of getting better..

I have been a Virginia Workers Comp Lawyer for over 35 years. I can tell you that each case is different. Each insurance company is different. You say you wish to "settle" your case after your surgery. The insurance company is usually interested in settling a case if it is "cheaper" for them to do this rather than continue to pay you weekly compensation and medical care. If the insurance company thinks it is "cheaper" to give you a lump sum settlement it will do so rather than continuing to pay you on an ongoing basis. It can help to utilize an experienced Workers Comp Lawyer to obtain the best settlement. You may have to show the Commission you have an alternative way to pay your medical bills. You can settle your case. The issue is for how much. It takes both you and the insurance adjuster to agree to an amount.The key is to maximize the settlement so you can move on with your life.
