That question is a little like, "What's the best way to find a spouse?" The answer is different in every situation and there are many ways to handle that, depending on whether the buy-out is friendly or not so friendly, whether the partner needs cash quickly or not, and why the partner is being bought out. Also, is this really a partnership, or is it a corporation or an LLC?

This is something you are going to want to have done correctly. Find an attorney that you are comfortable with and discuss it in detail with him or her for the most useful answer to your question.

As a Franchise Attorney I agree with the other attorney answer. Does your business partner want to sell? Are the terms worked out or subject to negotiation? There are so many different factors to consider. You really need to consult with a good business or franchise attorney in your area for specific advice.
