Legal Question in Civil Rights Law in Washington

Video Taping the birth of our child

Can a Doctor or a Nurse or any hospital staff legally demand that you do not video tape the birth of your child. Can they make you turn it off when the birth begins?

Yes, they can. More and more hospitals are denying parents the opportunity to tape the birth of their children because they fear if something goes wrong, the tape will be used in a medical malpractice lawsuit. Id bet this is why your provider is denying you the ability to tape the birth of your child.

The birthing of a child is a professional service that they are providing presumably inside a medical facility. The requirement that the taping not occur is a condition precedent to providing these services. In theory, if you dont like that requirement, you can take your business elsewhere to another hospital or doctor that may allow you to make such a video.
