Cancelled Warranty Refund

A few months ago I purchased an extended warranty for my used car. I purchased the warranty with a down payment of $350.00. I just had them draft the money out of my checking account. I contacted a few car dealerships in my area asking about the warranty, and they said that did not accept it.

After learning this, I contacted the warranty company and cancelled the warranty. They told me that the warranty was cancelled and the money would not be deducted out of my checking account. Well, it was.

After contacting the warranty company, they assured me that my refund would be sent to me within a six week period. It never came.

After the six week period, I called the customer service department probably once a week, and they always told me that my refund was being sent out.

Well it has now been almost six months since I cancelled the warranty, and the customer service department is saying that their company is in receivership, and they do not know if I will ever receive my money.

Could you please tell me if there is anything that I can do about this? I know that $350.00 is probably not alot of money to you, but it is alot to me, especially just to throw away.

Contact the state's Attorney General's office and speak with someone in the Consumer Fraud division.

These extended warranties are typically written by a specialized insurance company. If they are in receivership, which is the insurance industry's equivalent of bankruptcy, you might have a chance at recovering something by contacting the commissioner of insurance in the state where the company was located. They'll send you a claim form with which you can put forth your claim, and perhaps get some of your money back.
