Being charged with a crime that has been dismissed!

Hello, My question is in 1994 i was arrested for assult 4 and went to court the next day the judge told me that he will dissmiss the case and it will be taken of my record. with that said i had to do an fbi back ground check and my assult came up. i called the court house they got my records out of archives and the case said dismissed i was never conviceted of this crime. i have been denied for permanent crime (OAR410-007-0280 and False statement (OAR410-007-0280) undisclosed out of state history. when i spoke to the court house the lady said i should have done this the way i had i should not have marked yes i have been convicted of a crime. the other thing is i have been working for them since sept.28-05 and been receiving money and now i wonder if i will have to pay it back. iam going to file a hearing request. if you have any information that would be helpfull to me i would love to hear it. even if its not what i think iwant to hear. thank you
