Legal Question in Criminal Law in Washington

How can I get Expunged?

I would like to get expunged of a felony crime that was committed 12 years ago (operating a motor vechile without permission). I have done everything that I was suppose to. I have not committed any other crimes since and I am not wanted for anything. I was young and stupid and would like to get this taken off my record or at least sealed. I was living in Washington State at the time that that is where the crime was committed. I have been living in Oklahoma for the last 3 1/2 years. I would like to know where I would need to retain a attorney and if I would have to appear in court in Washington. I have a job and family in Oklahoma but would be willing to travel to Washington to have this cleared up.

Re: How can I get Expunged?

If you completed the requirements of your sentence and received a certificate of discharge, you MAY be eligible to apply to the sentencing court for a vacation (or deletion) of the record of that conviction. RCW 9.94A.640 outlines the requirements for eligibility. So the answer to your question is if you are eligible, you will need to apply to the sentencing court and the crime must be one that the law allows to be vacated (or expunged). If you would like to discuss this further, feel free to give me a call. My office is located in Tacoma and the telephone number is 253-284-0064.
