Minor in Possesion of Alcohol

I have a cousin that was issued a citation for minor in Possesion of Alcohol. He was never read his miranda rights and he was released with a court date coming up. Since he was never read his rights, was all evidence obtained illegally? If not, what is the statue of limitations, given the fact he has never been in any trouble and he will be 21 in two months? Thanks

Miranda warnings need only be given if the person ios questioned by police. If all the police did was issuea citation, and asked no questions, then no Miranda was required. The statute of limitations is 3 years for mesdemeanors but is suspended if a court date is missed and a warrant is issued. Your cousin shoul dget a good lawyer immediately. Good Luck!
