Sexual misconduct involving consenting minor and much older boyfriend

A 16 year old girl gave birth to the child of a 23 year old man. She entered into the sexual relationship freely at the age of 15. According to my understanding of RCWs 9A.44.083 and 9A.44.079 his activities with her were child molestation in the first degree and rape of a child in the third degree. How would I go about getting him prosecuted for this? (He is attempting to gain custody of their infant daughter.)

1. Call the police and ask to press charges. It's hard to argue with the dates.
