If you want to have a misdemeanor conviction vacated, one of the things you must do is file a motion with the sentencing court. In addition to bringing this motion, you must also provide the prosecuting attorney's office with timely notice of your motion and declaration. However, in order to have your conviction vacated, you must meet certain requirements. These requirements are outlined in RCW 9.96.060. The criteria outlined in that statute will help you decide whether you are eligible to have your conviction vacated. The good news is that if your conviction is vacted, when you respond to questions on employment or housing applications, you can state that you have never been convicted of that crime.
