Legal Question in DUI Law in Washington

alcohol treatment

My daughter was told she had to do an outpatient alcohol class and then tested positive on her unrinalysis. Nos, they tell her she needs to do a year long outpatient treatment. She has no way to pay for it and she would like to know what they will do if she does not comply? She committed her DUI over a year ago.

Re: alcohol treatment

This is one of those matters that is very much in the discretion of the judge so having a local attorney familiar with the judge give you an opinion would be best. Judges in general do not like someone not following through with their chemical dependency treatment. He is likely to give her substantial jail time 30-90 days and tell her to then do the treatment anyway. Or, I've seen judges give the full year maximum in lieu of the required treatment. Hopefully, the judge your daughter is before is more lenient than that.
