He is on probation for a dui and 2 assault charges. Three a month ago he was arrested for evading the police and has a court date on the 2nd for that charge. Two nights ago he got another dui. What are the penalties he will receive?

Re: broke kui probation

That sounds like just a whole lot of trouble. Predicting the penalties is almost impossible. Every judge, and for that matter prosecutor, is different. Further, I don't know enough about the facts to know if there are aggrevating factors that make it worse. How drunk was he in the DUIs? What degree were the assaults? How badly hurt were the victims? Did he endanger anyone while evading the police? Was he drunk then too? The max one one dui is one year in jail. If they are assault 4th degree, the max is one year. Evading has a maximum of 5 years I believe. So the maximum he faces is 9 years, unless the assaults were in a higher degree. A good lawyer will get him significantly less time than all of that.
