My brother was killed in a car accident. The other car crossed the center line and caused the head on collision. If my brother was under the inflounce of alcohol, does the accident automaticly become his fault?

No. As you say, the other car crossed the center line. There may be some showing that, if not intoxicated, your brother may have been able to avoid, but this would be contributing causation and not still not his fault.
