Legal Question in DUI Law in Washington

dui

I got a DUI in Dec '07', I had a lawyer but she with-drew because I was late on a payment. I got my Evaluation done, And she is recommending a 1 day -8hr alcohol class and thats it, I have no priors , So do you think I could ask the courts to give me a deferred sentence, like 1yr, I get into no trouble and a small fine? If I comply It gets dismissed? I already got my Drivers license back, I am at the end of this , But w\ no direction... Thank you, Michelle

Re: dui

Michelle,

Thank you for the question. It is very unlikely that you'll get a deferred sentence. There is mandatory jail time even on a first offense DUI. Also, the mandatory fine is about $1,000, depending. If you cannot afford to pay your attorney you should ask the court about appointing you a public defender. DUI's are legally complicated and you will likely benefit from a lawyer's assistance.
