Legal Question in Family Law in Washington

agreed relocating

I'm moving w/ child.

Ex and I are already in diff states.

We agreed that current Parenting Plan will stay same and he agrees to the move.

Do I need to file a new parenting plan?

I saw the instructions on the WA courts website but we dont want to modify the parenting plan so how can i get an order for relocation?

And if he agrees and is completing docs willingly, do I still have to technically have him served?

Re: agreed relocating

If you have primary residential custody you need to file a notice of intended relocation. If he will sign the thing it can be an agreed notice of intended relocation. The court will be satisfied that you have met the requirements of the statute, and you have filed the correct form.

The principle is not to disrupt the relationship with the other parent. If that is not what is happening here, then have him "join" the notice and BOTH of you tell the court what you have decided.

If he will accept service, no, you do not have to have him served.

Hope this helps. Elizabeth Powell
