Legal Question in Family Law in Washington

Custody??

I recently gave birth to a baby girl after nine months of a very difficult pregnancy I spent several months in the hospitol. The father left me after I refused to get an abortion and then was absent throughout the entire pregnancy. Now that the baby is born he wants her. What are my chances of getting full custody with visitation only for him. I left him off of her birth certificate. This is his first child but my second I have full custody of my first daughter

Re: Custody??

MY crystal ball is broken, but what you are describing is fairly typical when a new father learns he will need to provide support for his child.

If you have serious drug/alcohol/mental health issues or something that would impair your ability to care for your child, it is possible that the court would award him custody. But . . . highly unlikely, if that's what you needed to hear.

Hope this helps. Elizabeth Powell

Re: Custody??

The prospect of your having the child with you most of the time and having yourself designated as being the custodial parent are good. The father would generally be able to expect residential time with the child that would expand as the child matures. Decision making may be an issue for you. Leaving his name off the birth certificate is only a minor hurdle if he asserts paternity.
