Legal Question in Family Law in Washington

Need help

My fiance and i been living together for several years now.We constantly fight,like every other day and I'm sick of it.We have 1 daughter who's 3 years old.We're both on her birth certificate,but she carries his last name.My fiance is the provider because i stay home and watch the kid.If i leave Washington state with the kid without him knowing or going through a legal process,I'm i gonna be charge with anything if he goes to the cops?I really don't want to get court involve,all i want is to take my kid and go,and the only way is if he's not around.Is it illegal for me to take our daughter without him knowing and leave washington?Do i really need to let him know that we're leaving,date,where we're going and all that information?And if we do go to court will this effect my chances of getting custody of my daughter?

You both have full authority relating to the child until a court defines the limits in a parenting plan/residential schedule. You should be aware that even if you take child out of WA he can still file for a parenting plan in WA for up to 6 months after the child leaves WA. As the primary residential parent you would have a high probability of being designated as the primary residential parent or "custodial parent" unless there is some problem that you have not disclosed.
