A Good Father's Rights Are What?????

My brother is currently facing a divorce brought about by his wife. It is a complex situation like most divorces are. So, here are the details.

She is 24, he is 28

The daughter is 2

Currently Megan, the mother is living with her parents an hour and a half away from Seattle (which is where they were raing their child)Her parents are extremely religous and have three out of five of their kids run away out of desperation. They are attempting to take total control of his daughter.

Now, Megan is saying that my brother cannot see their daughter except for everyother weekend. They are only separated and headed for a divorce. She has just taken the daughter out of her home and moved her away from her father. What are his rights? Can she just control the situation?

Also, she has extreme emotional tendencies as does my brother. She is claiming that he has driven drunk (after two glasses of wine) with their daughter in the car and has abused Megan. They had a mutually angry and unhealthy relationship. What can he do? What can I do?

It sounds as if there are going to be serious problems for both sides in a dissolution proceeding. I say this based upon your statement that, "she has extreme emotional tendencies as does my brother."

Nevertheless, what you can do is help your brother get an attorney to immediately file for dissolution, which would include a proposed parenting plan and temporary orders for child support.
