Legal Question in Family Law in Washington

Lack of representation for custody hearing

A friend has a 2 year old child with an ex-boyfriend, they were never married. The courts instructed them to work out a custody plan between themselves before a specified date (November 11,2002) and she was under the impression that they were doing exactly that.

However, she has noticed that he is not interested in discussing the subject with her any longer and makes frequent mention of their court date. She has also discovered that he has obtained an attorney and submitted witnesses...and it is past the date for her to do the same.

She is very worried that he is planning a sneak attack in court to try to take her son away and doesn't know what to do first. Could she request a delay in the hearing at this late date?

Re: Lack of representation for custody hearing

It may be possible for the parties to stipulate to a continuance of the hearing. If all parties involved will not agree to a continuance, then the mother may be able to request a continuance from the court.

It is important to meet court deadlines. I understand that the judicial system can often be quite confusing for a pro se litigant. The mother of the 2-year-old child should likely seek legal assistance.

I am available for consultation. Please feel free to contact me if you would like assistance with this matter.
