I want to move with my son

My son is 4. His father and I aren't together. He does not support my son at all. We never went to court, but did fill out papers at the prosicuting attornies office stateing that I have custody. I want to move out of state. My sons grandparents take care of my son alot and I am afraid that they will have a problem with the move. Also that his father will try to stop me. Am I within my legal rights. He does ''see'' his son but only because he lives with his parents. He does not pay child support. Can I move?

I would suggest you have an attorney advise you on the law as well as your options and strategies. You raise at least several issues: relocation, whether the grandparents can legally enforce their right (if any) to contact with the grandchild.

You should not tell anyone you are thinking of moving until you have had the advice of your attorney because there may be some strategies you may wish to implement before you reveal your plans.

Do you have a parenting plan signed by the court in effect at the present time? You may have to comply with the Parental Relocation Act, depending upon what paperwork is in effect. The U.S. Supreme Court has struck down the grandparent visitation law in Washington. And remember, visitation is not tied to whether or not the other parent pays child support to you. You need to seek the advice of an attorney ASAP before you make any preparations to move and get an idea of what your rights and responsibilities are in this situation.
