Property Division

My Ex Husband & I have been Divorced a little over 7 years. I received the house & property in the divorce. Now, almost 8 years later, during a re-finance, I found out his name is still on the Title. He is refusing to sign a Quit Claim Deed to remove himself from the Title. What other means do I have of getting him off the Title.

If you had an attorney during your divorce, you can call them and ask for help with this. Your remedy depends on what your decree says. I can't tell from here.

What the attorney will probably do is file a motion for an order enforcing the decree and for attorney fees for the necessity. He or she will ask the court to appoint a special master to sign the deed if your ex will not.

This will cost your ex a LOT of money.

Please contact your local Bar Association for a referral if you need a new lawyer. This is a family law/real property problem of post decree enforcement.
