my son is in a custody battle over his daughter and a Guardian en litem has been appointed there is no parenting plan in place yet, mother has taken off to another state, is that kidnapping?

If there is a pending custody dispute between your son and the mother of his child, there should be, at a minimum, temporary orders in place that set general guidelines for custody of the child while the matters are proceeding. If the mother has taken off to another State without providing notice to the father, it could potentially be contempt of court and possibly custodial interference. This question IS, however, very fact specific and there may be no violation after examining fully the facts of the mother's relocation and the orders in place in the pending case.
