Legal Question in Immigration Law in Washington

Waiting time after submitting EOIR-33/IC

I applied asylum and in removal proceeding with EOIR. I am scheduled for individual hearing in Los Angeles October 2009. I just moved to Seattle 2 days ago and today I sent AR-11 and EOIR 33/IC form for address change notification. My question is: Is my case going to be handled by Seattle Immigration Court or still staying in Los Angeles? If It is transferred to Seattle, based on the judge's busy schedule. When am I going to be scheduled for next hearing in Seattle. Is it going be a master hearing again in Seattle or just individual hearing? Do you think Immigration will call me within this 2 months? I need to know this time frame because I am in process of looking for new lawyer right now. Thanks.

Re: Waiting time after submitting EOIR-33/IC

The fact that you filed the change of address form does not preserve the transfer of the file to the Immigration Court in Seattle. Your new attorney will have to file a Motion to Change Venue at least 15 days before the next hearing. Otherwise, you will have to appear in the Immigration Court in Los Angeles. If the Motion to Change Venue is not granted and you do not appear, you could be ordered removed in asentia. Be very careful with that! You will have another master hearing in Seattle again and will have enough time to find another attorney. If you have an attorney in LA, you can ask him/her to file the Motion to Change Venue. Good Luck!
