Legal Question in Employment Law in Washington

Payroll Deductions

If my employer stated orally that they were going to take some money out of my paycheck every month, but they did not say how much they were going to take out do they have the right to take out 40 to 50 percent of my paycheck without notifying me so that i can plan my bill payments at the begining of the month and the end of the month prior. I was just given a 190 check and they took out 85 dollars without notice to me and in my last check they said that they were taking out about twenty percent but they did not inform me this time, what are my legal rights in this situation.

sincerely,

Re: Payroll Deductions

I would need more information to give you a helpful answer. WHY are they taking money out? Are your paychecks being garnished to pay child support or an unpaid debt? Is there more than one creditor? Or is this a debt that the company deems that you owe to them? Or is there some other reason?

You should be receiving notice of some sort if your wages are being garnished. There is a set percentage that the court will establish, though your income cannot fall below a certain level.

If the employer is trying to collect on a debt you owe them, there are other controls in place as well. They can only proceed without your consent in a limited set of circumstances.
