Legal Question in Employment Law in Washington

small claims court

I had a verbal agreement with a employer to pay me a bonus and Perdium for working out of state. I need to know if A verbal agreement will hold up in a small claims court. This seems to be the only way I can collect the money owed.

Oral contract valid in Small claims court

Unless it violates the statute of frauds, RCW 19.36.010 at http://leginfo.leg.wa.gov/pub/rcw/title_19/chapter_036/rcw_19_36_010, an oral contract is enforceable in any court with subject matter jurisdiction, which in this case would probably include small claims court if you meet the requirements.

Probably the key question is whether the contract was to have been completely performed within one year. If so, you are probably okay.

See chapter 12.40 RCW at http://leginfo.leg.wa.gov/pub/rcw/title_12/chapter_040/ for small claims court chapter.
