improper 20 day notice?

we turned in our 20 day vacate notice on the 12th of may which was a saturday. The office did not get it until Monday and unfortunately it was not dated so they cfounted it as being recieved on the 14th. They say we owe for all of next month. Do we?

Re: improper 20 day notice?

It was arguably untimely, not improper. You should have turned it in on or before the 10th of the month.

That said, they know you are leaving, and can make arrangements. Your error was what a judge would call "de minimus" and *probably* would not find a basis to charge you another month's rent.

But my crystal ball is on the fritz; my best advice to you is not to take legal advice from persons who are not lawyers. Your apartment manager is probably not a lawyer.

Hope that helps. Elizabeth Powell
