Legal Question in Personal Injury in Washington

3rd party payments and law

i bill for a chiropractic/massage clinic. in 3rd party claims (lien is filed w/ pierce co.) can the payment from the ins. co. be a two party check... for us and the patient? i am dealing w/ an out of state ins. co that wants to pay our cash massage price ($60.) instead of our billed ins price (123.28). i have never had this be an issue before. they say that the patient never knew she could pay $60. at time of service or would have to pay $123.28. their arguement is that there is no ins involved and the patient should only be responsible for patient prices. does our lien protects us and makes them legally responsible for the whole amount? and can they issue the check to our office and the injured party?
