Daughter cut thumb at Wal-Mart, negligence on their part

My 2 year old daughter put her thumb into a metal hole that was on the checkstand. She fell down and cut her thumb open, which required a trip to the ER. The DR. spared her stitches and Dermabonded it. Wal-Mart claims called me to see how she was and admitted that there should have been a plastic tube where the hole was. They said if we kept the claim open they could pay for medical and ''whatever else.'' What kind of legal recourse do we have?

You have a personal injury/negligence claim against Walmart. Your daughter is entitled to money for her pain & suffering. There may be future scaring as well as a need to have a consultation with a plastic surgeon. If you have a lawyer handle the claim you can expect to receive much more money than if you negotiate the claim yourself.
