Hit by unlicensed illegal alien

About a year ago I was struck from behind by an unlicensed illegal alien in his van. My family and I were all injured. What factor should the status of the other driver play in the insurance companies settlement offer?

I agree entirely with Mr. Nute. In addition, however, I have a few other comments:

You didn't say whether or not the other driver had insurance. If not, you can sue him as an individual if the driver has assets.

You will probably recover only up to the limits of your own policy if none of the above apply. That's why it's important to make sure you always have adequate insurance coverage of your own.
