Legal Question in Real Estate Law in Washington

rcw 64.38.045

i am a member of good standing with a homeowners association. the board of directors will not let me review all the files and records . how can i get this information: rcw 64.38 045 the attorney generals office gave no assistance.

I think you need to draft a letter to the HOA and cite RCW 64.38.045(2) as authority for your demand to view the HOA records. If you are still refused, please contact me and I will gladly handle this matter for you. Sometimes all it takes is a letter from an attorney to whip an uncooperative HOA board into shape. You may also be entitled to attorney's fees as a result of their initial refusal to cooperate. This is why I think you need to write that first letter yourself.

You need to have an attorney draft a letter for you regard this matter. Should the HOA still prohibit your access, you could file a lawsuit compelling them to do so. Note that under the WCA you can get attorneys fees for having to bring the lawsuit.
