Able to sue for pain and suffering for a child

I was involved in a traffic accident 3 days ago. The guy that hit me was at 100% at fault. He was running from someone else he had just rear ended and was drunk. He hit our vehicle and and luckily no one was injured. However, since then my 2 year old son cries everytime we put him in the car. He ducks and screams if he hears squeeling tires and he's scared of trucks because a truck ''hurt'' mommy's car. The driver was uninsured and is now in jail. I will be sending him a letter asking him to pay for our $500 deductible and for a new child restraint seat since they are concidered unsafe after being in an accident. I was just wondering if it's possible to sue for emotional pain and suffering for a child. Even if the money was to go to a charity instead of my son, it would be good. I just think he should be punished. Thank you for your time.
