She left 33.3% to my 2 brothers and myself. I took care of her for the last year in her life when she became completey incapasataded. My brothers now want to sue me for moneys I have all reciepts ect. for. My big problem is that 2 hoursafter my mom died my brothers came and changed the locks,and securty on her house so i no longer sould get in my moms home. She died June22,2008. They will not let me in to get my own things, I can't get her ashes which asked me to take care of and I want 1/3 of what is mine. Can I legally go in her house with out them?

Who is the Personal Representative or Executor nominated in the Will? Has probate been filed? If probate has not been filed, you may want to file. In probate you can assert your claims as a creditor (for expenses incurred on your mother's behalf). You may also assert your claim to a share of the estate (either under the will or your intestate share). As to whether you can enter the property without your brothers' agreement, that would depend on what the will says about who administers the estate (or in the alternative what the probate court says about who will administer the estate).
