Are you able to keep your car and other neccissities if you petition the court for debt relief?

The purpose of bankruptcy is to provide a fresh start. West Virginia allows for exemptions from the Trustee's power to administer assets in a Chapter 7. W. Va. exemptions include up to $2,500 equity in an automobile for each debtor. W. Va. also allows up to $25,000.00 equity in real estate and if a debtor does not have that much equity in real estate, he or she may apply the exemption to any property, including one or more automobiles. The federal exemption and some of the other states are not as generous. You must live in a jurisdiction for more than 720 days to enable you to select that state's exemption law.
