Power of Attorney

My stepdaughter has power-of-attorney for an elderly

gentleman who is not a blood relative. She wrote

herself a $10,000 ''gift check'' on his account.( We told

her to void the check or if she had already cashed it, to

redeposit the money immediately!!) What could befall

her legally for this breach of trust?

This breach of fiduciary duty could result in a theft charge if the money was not used for the benefit of the ward.
