Legal Question in Family Law in West Virginia

Age for a name change

How old does a child have to be before they can legally change their last name without both parent's consent? The child in question lives with his mom and step-father and has very little to do with his biological father. He would like to have the same name as his younger brother and sister.

Re: Age for a name change

A child has the right to petition the Court at any time for a change of name. If either parent objects, it is within the discretion of the Court as to the granting of the petition. After the child turns 18, the parents should not be able to intervene.
