Legal Question in Wills and Trusts in West Virginia

My mother recently passed without a will and my father has also passed leaving my brother and I as the surviving heirs. We plan to hire an attorney to handle the probate process. We want to have an estate sale for most of the home contents, then sell her home and vehicle. There are some items in the home that we would like to keep, such as photos, paintings, glassware, sewing machine, rocking chair, cedar chest, tools etc. Are we able to remove items from her home or are they property of the state until probate is completed?

Please accept my condolences on the loss of your mom.

If you're going to hire a lawyer to handle the estate, you may as well ask the lawyer face-to-face, as sometimes the rules are different depending on what county mom lived in.

Once again, please accept my condolences on the loss of your parents.
