Right to Appeal

I was found guilty of an OWI in July of this year.

My attorney advised me to appeal the decision and go to jury trial to have it over turned. Within the 15 days I had to decide I filed for my appeal.

Now it is mid-October and the Rock Co. courts have not recognized my appeal yet, and so my license is under the same suspension as if I had not filed.

Also the court fines are not paid do to the stay of appeal I would have had and are over due creating another 1 year suspension in effect currently.

I have 3 questions:

''Who has dropped the ball on my appeal and what can I do about it?''

''I have the right to a Occupational/Restricted License

should I waste time asking for one now?''

''I talked to my attorney they said they had to talk to the judge, dose that make any sense?''

I would continue talking to your attorney. A lot of these things are at the judge's discretion and can move a bit slowly, you just have to be patient and stay proactive making sure the attorney is getting everything taken care of.
