Legal Question in Bankruptcy in Wisconsin

I filed chapter7 this past year. Before I knew I was going to file I sold some jewerly to help pay bills. After I was discharged I received a check from a place that was guarnashing my wages. It was enough money for me to buy back some of the items I had sold. A couple of months ago my home was broken into and some of the items were stolen. I filed an insurance claim for them. Now my insurance wants to know why the items were not disclosed in my b.k. I told them I sold them and bought them back. Did I not knowingly break the law?

I would recommend that you consult your bankruptcy lawyer immediately. If you truly did not own or possess the jewelry when the bankruptcy was filed, you had no obligation to report it. However, if you forgot to list it or intentionally concealed it from the trustee, you could have a much bigger problem. Options such as amending your bankruptcy paperwork to correct the situation may still be available to you. You also do not state the value of these items. If the total value of the jewelry was less than $200, it may not be too great of a concern. I would also recommend that you have an attorney reply to your insurers inquiries, both in order to protect your claim and the make sure that you don't get yourself into trouble. Please be aware that my responses to you in the public web forum do not make me your attorney and that I am not representing you or taking any action on your case.
